WHAT ARE DAMAGES?

A sum of money awarded to a person injured or who has suffered a loss by the tort of another. Examples of types of "damage awards" or "loss" are: loss of earnings, pain & suffering, diminished earning capacity, etc.

WHAT IS A TORT?

A private or civil wrong or injury, including action for bad faith breach of contract, for which the court will provide a remedy in the form of an action for damages.

WHAT IS PERSONAL INJURY?

Any harm or damage done to a man's/woman's person, whether by accident or otherwise, which incapacitates him/her in whole or in part.

WHAT WILL WE CLAIM FOR YOU?

We will assess and claim your damages based on the various areas of loss incurred by the injured party. There are two types of claims that can be advanced on your behalf: a tort claim and an ICBC claim (if personal injury has arisen due to a motor vehicle accident).

WHAT ARE COSTS?

Costs in a legal action is an allowance made to the successful party (and recoverable from the losing party) for his/her expenses in prosecuting or defending an action or a distinct proceeding within an action.

WHAT ARE DISBURSEMENTS (CASE EXPENSES)?**

Disbursements or case expenses are the actual monies carried and paid for by the law firm to prosecute your case. A list of some of the expenses is as follows: doctor's fees for records/reports, court fees, investigation fees, photocopying, couriers, court fees and witness fee. Typically, 80 – 90% recovery for these disbursements may be expected. Note that the client is responsible for these expenses incurred regardless of the outcome of the case.
